These Terms of Use (the “Terms”) govern your use of Orbital Dodge (“the app”), a game published by Marmik Shah (“we”, “us”). By downloading or using the app you agree to these Terms. This agreement is a licensed-application end user license agreement between you and us only, and not with Apple Inc. (“Apple”). We — not Apple — are solely responsible for the app and its content.
Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple’s App Store Terms of Service. You may not copy (except as allowed by the licence), modify, reverse-engineer, decompile, distribute, sell, rent, sublicense, or create derivative works of the app, except to the extent such restrictions are prohibited by law.
In-app purchases
The app is free and offers a single optional in-app purchase — a one-time, non-consumable “Remove Ads” unlock. Purchases are processed by Apple and billed to your Apple ID at the price shown at the time of purchase, which may change. Because it is non-consumable, you can restore the purchase on your devices using the in-app “Restore Purchases” option. All billing, refunds, and payment disputes for in-app purchases are handled by Apple under the App Store Terms of Service; we do not process payments and cannot issue refunds directly.
Advertising
Unless you buy the Remove Ads unlock, the app is supported by ads served through Google AdMob. How advertising data is handled — and the choices you have, including App Tracking Transparency — is described in our Privacy Policy.
Maintenance and support
We are solely responsible for providing any maintenance and support for the app, to the extent we choose to offer it. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
Warranty
The app is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind to the maximum extent permitted by applicable law. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility. Nothing in these Terms limits any statutory consumer rights you have that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of, or inability to use, the app.
Product claims
We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual property
The app and all related content, including its code, art, sound, and the name “Orbital Dodge”, are owned by us and protected by intellectual-property laws. In the event of any third-party claim that the app or your possession and use of it infringes that party’s intellectual-property rights, we — not Apple — are solely responsible for the investigation, defence, settlement, and discharge of any such claim.
Legal compliance
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple as a third-party beneficiary
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Changes to these terms
We may update these Terms as the app evolves. Material changes will be reflected here with a revised effective date. Continued use of the app after an update constitutes acceptance of the revised Terms.
